Case Note & Summary
The appellant, M/s. Rajeshwari Cotton Ginning and Pressing Industries, a registered firm engaged in the business of purchase and sale of lint, ginning of cotton, and sale of cotton seeds oil and cake, filed its return of income for the assessment year 1987-88 declaring total income at Rs. Nil after setting off net profit of Rs. 23,072 towards total loss and carrying forward the losses to subsequent years. The return was selected for scrutiny, and notices under Sections 142(1) and 143(2) of the Income Tax Act, 1961 were issued. The Assessing Officer passed an order of assessment on 26.03.1991, disallowing the claim of carry forward of depreciation and set off of business losses. Aggrieved, the assessee appealed to the Commissioner of Income Tax (Appeals), who dismissed the appeal. The assessee then appealed to the Income Tax Appellate Tribunal (ITAT), Bengaluru Bench, which also dismissed the appeal by order dated 31.07.2009. The assessee filed the present appeals under Section 260A of the Act before the High Court of Karnataka. The core legal issue was whether the assessment order dated 26.03.1991 was barred by limitation under Section 153 of the Act. The court noted that the assessment year in question was 1987-88, and the assessment order was passed on 26.03.1991. Under Section 153 of the Act, the time limit for completion of assessment for the assessment year 1987-88 was two years from the end of the assessment year, i.e., by 31.03.1990. However, the assessment was completed on 26.03.1991, which was beyond the prescribed period. The court held that the assessment order was clearly barred by limitation and therefore invalid. Consequently, the disallowance of carry forward of depreciation and set off of business losses could not be sustained. The court allowed the appeals, set aside the orders of the ITAT and the lower authorities, and directed that the assessment be treated as time-barred.
