Case Note & Summary
The petitioner, Professor Dr. Nayyar P. Siddiqui, filed a writ petition challenging the communication dated 22/9/2005 from the Deputy Registrar (Ph.D. Cell) of Sant Gadgebaba Amravati University, which informed her that her treatise for the Degree of Doctor of Letters (D.Litt.) in the faculty of Arts had been disapproved. The petitioner had submitted a treatise titled 'English and Urdu Poetry: A Parallel Literary Study' for the English subject. The treatise was referred to two examiners appointed by the Board of Examination: Prof. Sattar and Prof. Mohammad Sharf-E-Alam. While Prof. Mohammad Sharf-E-Alam recommended the treatise as a research work of very high order, Prof. A. Sattar's report was not affirmative. The Board of Examination and Management Council considered the reports and recommended the matter to the Academic Council, which disapproved the treatise. The petitioner contended that Prof. A. Sattar was biased against her, as evident from personal comments in his report, and that he valued the treatise with a biased mind. The petitioner argued that the procedure under clause 8 of Ordinance 111 of Amravati University was not followed. The court heard arguments from Mr. Zaka A. Haq for the petitioner and Mrs. D. Khade for the respondent University. The court held that in academic matters, the court should not substitute its own opinion for that of the academic bodies unless there is a clear violation of statutory provisions or mala fides. The court found that the petitioner failed to demonstrate any personal bias or mala fides on the part of Prof. A. Sattar, and that the procedure under Ordinance 111 was followed. The court dismissed the writ petition, upholding the decision of the Academic Council.

(Paras 5-6) C) University Ordinance - Ordinance 111 - Procedure for D.Litt. - The court noted that the procedure under Ordinance 111 of Amravati University was followed, and the Academic Council's decision was based on the reports of examiners.
