Case Note & Summary

The petitioner, Ramesh s/o Mahadeorao Ukande, was appointed as an Observer in the India Meteorological Department on 19.11.1986 against a post reserved for Scheduled Tribe category. He continued in service and retired on superannuation on 31.12.2019. On the date of retirement, his tribe claim was pending verification before the Scheduled Tribe Certificate Scrutiny Committee. The employer withheld his pensionary and retiral benefits pending the outcome. Subsequently, on 16.06.2021, the Scrutiny Committee invalidated his tribe claim. Consequent thereto, the employer issued a communication dated 26.11.2021 informing the petitioner that he was dismissed from service and not entitled to retiral benefits. The petitioner challenged the communication before the Bombay High Court. During the pendency of the petition, the petitioner amended the petition to challenge the order of the Scrutiny Committee, but at final hearing, the petitioner did not press the challenge to the invalidation order and confined the petition to the original reliefs regarding retiral benefits. The court considered the legality of the communication dated 26.11.2021 and the claim for release of retiral benefits. The court held that the petitioner had already retired on superannuation on 31.12.2019, and the order of dismissal passed after retirement is a nullity as there is no employer-employee relationship after superannuation. The court further held that pensionary benefits are not a bounty but a right earned by past service, and the forfeiture of past service under Rule 27 of the Maharashtra Civil Services (Pension) Rules, 1982 cannot be invoked after retirement. The court allowed the petition, set aside the communication dated 26.11.2021, and directed the employer to release all retiral benefits including pension, gratuity, and commutation within three months.

Headnote

A) Service Law - Pensionary Benefits - Withholding of Pension - Invalid Caste Claim - The employer cannot withhold pensionary and retiral benefits of an employee who has already retired on superannuation, merely because his Scheduled Tribe claim was subsequently invalidated by the Scrutiny Committee. The right to pension is a right earned by past service and is not a bounty. The communication dated 26.11.2021 withholding benefits was set aside. (Paras 2-8)

B) Service Law - Dismissal vs. Forfeiture of Past Service - Invalid Caste Claim - The order of dismissal from service passed after retirement is a nullity as there is no employer-employee relationship after superannuation. The forfeiture of past service under Rule 27 of the Maharashtra Civil Services (Pension) Rules, 1982 cannot be invoked after retirement. (Paras 6-7)

C) Service Law - Retiral Benefits - Invalid Caste Claim - The employee is entitled to all retiral benefits including pension, gratuity, and commutation, as the invalidation of caste claim does not affect the right to pension earned by past service. The employer is directed to release all retiral benefits within three months. (Para 8)

Nature of Litigation

Writ petition challenging communication withholding pensionary and retiral benefits after invalidation of Scheduled Tribe claim.

Remedy Sought

Petitioner sought quashing of communication dated 26.11.2021 and direction to release retiral benefits.

Filing Reason

Employer withheld pensionary and retiral benefits after Scheduled Tribe Certificate Scrutiny Committee invalidated petitioner's tribe claim.

Previous Decisions

Scheduled Tribe Certificate Scrutiny Committee invalidated tribe claim on 16.06.2021; employer issued dismissal communication on 26.11.2021.

Issues

Whether the employer can withhold pensionary and retiral benefits of an employee who has already retired on superannuation, on the ground that his Scheduled Tribe claim was subsequently invalidated by the Scrutiny Committee.

Submissions/Arguments

Petitioner argued that he retired on 31.12.2019 and the tribe claim was pending on that date; dismissal after retirement is a nullity; pension is a right earned by past service and cannot be withheld. Respondent argued that due to invalidation of tribe claim, the petitioner is not entitled to retiral benefits as per rules.

Ratio Decidendi

Pensionary benefits are a right earned by past service and cannot be withheld after retirement on the ground of invalid caste claim. An order of dismissal passed after superannuation is a nullity as there is no employer-employee relationship. Forfeiture of past service under Rule 27 of the Maharashtra Civil Services (Pension) Rules, 1982 cannot be invoked after retirement.

Judgment Excerpts

The petitioner was appointed as an ‘Observer’ on 19.11.1986 against a post reserved for Scheduled Tribe category in the India Meteorological Department. The petitioner continued in service and attained the age of superannuation on 31.12.2019. The petitioner's tribe claim was subjected to verification before the Scheduled Tribe Certificate Scrutiny Committee on 21.12.2019. By order dated 16.06.2021, the Scheduled Tribe Certificate Scrutiny Committee invalidated the tribe claim of the petitioner. Respondent No.1-Employer issued communication dated 26.11.2021 informing the petitioner that in view of invalidation of his tribe claim, he is dismissed from services and thereby not entitled to retiral benefits. The petitioner does not press the challenge to the order dated 16.06.2021 and confines the petition to the original reliefs as prayed in the writ petition. The order of dismissal passed after retirement is a nullity as there is no employer-employee relationship after superannuation. Pensionary benefits are not a bounty but a right earned by past service. The forfeiture of past service under Rule 27 of the Maharashtra Civil Services (Pension) Rules, 1982 cannot be invoked after retirement.

Procedural History
