Case Note & Summary

The judgment pertains to a writ appeal filed by 15 appellants (originally 16 writ petitioners, one deceased) against the order dated 24.10.2018 in W.P.No.4604 of 2013. The appellants were engaged as full-time Sweepers in the Coimbatore Commissionerate of the Tamil Nadu Police Department, some for over 30 years. They sought a mandamus for regularisation of their services, fixation in regular time scale of pay, and all consequential benefits. The writ petition was dismissed by the learned Single Judge, leading to the present appeal. The Division Bench noted that the appellants had placed on record details of their service, showing continuous employment without regularisation. The court observed that the appellants were entitled to regularisation and minimum time scale of pay from the date of initial appointment, relying on principles of equal pay for equal work and Articles 14 and 16 of the Constitution. The court condoned the delay in filing the writ petition, as the appellants continued in service and the claim was not stale. The court directed the respondents to regularise the services of the appellants (except one for whom no records were available) and pay minimum time scale of pay from initial appointment, with arrears computed within 12 weeks. For those who retired or died, pension and family pension were to be granted accordingly. The appeal was allowed in part.

Nature of Litigation

Writ appeal against dismissal of writ petition seeking regularisation of services and consequential benefits.

Remedy Sought

Mandamus directing respondents to regularise services as full-time Sweepers, fix in regular time scale of pay, and extend all benefits due to regular government service.

Filing Reason

Appellants worked as full-time Sweepers for decades without regularisation or minimum time scale pay.

Previous Decisions

Writ Petition No.4604 of 2013 was dismissed by learned Single Judge on 24.10.2018.

Issues

Whether the appellants are entitled to regularisation of their services as full-time Sweepers. Whether the appellants are entitled to minimum time scale of pay and pensionary benefits from the date of initial appointment.

Submissions/Arguments

Appellants argued that they have been working continuously for decades and are entitled to regularisation and minimum time scale pay. Respondents opposed the claim, but the court found that the appellants' service details were on record and they were entitled to relief.

Ratio Decidendi

Appellants who worked as full-time Sweepers for decades without regularisation are entitled to regularisation and minimum time scale of pay from initial appointment, with consequential pensionary benefits, based on principles of equal pay for equal work and Articles 14 and 16 of the Constitution.

Judgment Excerpts

In light of the categoric statement to the effect that there are no records of service available in regard to Mrs.C.Subbammal in the Coimbatore Commissionerate, we are not inclined to pass any positive direction in her case. We would thus simply close this writ appeal as far as this appellant is concerned, granting liberty to her approach the respondents with a representation, enclosing all relevant documents evidencing her service as a Sweeper in the office of the respondents.
