The plaintiff, State of Goa through Captain of Ports, filed an admiralty suit claiming recovery of Rs. 1,31,60,000/- for services rendered to the vessel M.T. PRATIBHA BHEEMA, which was owned by Pratibha Shipping Company Limited (in liquidation). The vessel developed a technical snag on 13.12.2012 outside Panaji Port limits and was anchored by the master. Subsequently, a warrant of arrest was issued against the vessel on 4.1.2013 in another suit, and the Deputy Sheriff directed the plaintiff to keep watch. The owner failed to take steps to move the vessel to a sheltered area, and in view of the impending monsoon, the plaintiff took steps to protect the vessel, including towing it to Mormugao Port on 13.5.2013 and later shifting it to Panaji port anchorage on 15.9.2013. The vessel was later sold pursuant to court order, and the sale proceeds were deposited with the court. The plaintiff claimed that the services rendered were necessary for the safety of the vessel and navigation, and constituted a maritime claim. The defendant (Official Liquidator) did not seriously contest the claim. The court held that the services rendered by the plaintiff were 'necessaries' and gave rise to a maritime claim enforceable in rem. The court allowed the suit and directed that the plaintiff's claim be paid from the sale proceeds, subject to deduction of court fees, and that the balance be paid to the Official Liquidator.

Plaintiff is the State of Goa which has filed this suit through Captain of Ports who is head of captain of ports department, Government of Goa. Plaintiff's case is that plaintiff had rendered services to a vessel by name m.t.PRATIBHA BHEEMA that was owned by Pratibha Shipping Corporation Pvt. Ltd. (in liquidation). On 13.12.2012, PRATIBHA BHEEMA, which was outside the Panaji Port limits which is under the charge of plaintiff, developed a technical snag and engines went out of order so also the generators. As the owner did not take steps to move PRATIBHA BHEEMA to a sheltered area, and in view of the impending monsoon, the plaintiff took steps to protect PRATIBHA BHEEMA from any impending disaster. On 13.5.2013 PRATIBHA BHEEMA was towed to Mormugao Port. On 15.9.2013 PRATIBHA BHEEMA was shifted by plaintiff from Mormugao to Panaji port anchorage. PRATIBHA BHEEMA was thereafter, sold pursuant to an order of this court and the sale proceeds are lying deposited with the Registry.

Procedural History

Suit filed in 2014. Vessel was arrested in another suit in January 2013. Plaintiff rendered services from January to September 2013. Vessel sold pursuant to court order. Plaintiff filed this suit for recovery of charges. Judgment delivered on 7.6.2018.
