Jalgaon, which refused to approve the appointment of Smt. Respondent no.3, Tukaram Umrao Mahajan, was appointed as Head Master on 1st June, 2008. He tendered resignation on 11th January, 2017, effective from 20th January, 2017. The Education Officer, after hearing objections from respondent no.3, passed the impugned order holding that the resignation was not accepted in accordance with the Rules. The petitioners argued that as a minority institution, the Rules do not apply, and the Education Officer had no jurisdiction. The court agreed, relying on the minority certificate dated 25th July, 2008, and held that the Rules are not applicable to minority institutions. The impugned order was quashed, and the Education Officer was directed to grant approval to the appointment of Smt. Suman Hiwale as Head Mistress.
