Nature of Litigation

Civil Miscellaneous Appeals under Section 173 of the Motor Vehicles Act, 1988 seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal.

Remedy Sought

Filing Reason

The appellants were dissatisfied with the quantum of compensation awarded by the Tribunal for the injuries sustained in the accident.

Previous Decisions

The Motor Accident Claims Tribunal (IV Court of Small Causes, Chennai) passed a common award dated 19.07.2022 in M.C.O.P. Nos. 6857 and 6856 of 2016, awarding Rs.13,94,400/- to the appellant in CMA 2744/2022 and Rs.2,82,000/- to the appellant in CMA 2745/2022 with interest at 7.5% per annum.

Issues

Whether the compensation awarded by the Tribunal is just and proper? Whether the claimants are entitled to enhancement of compensation?

Submissions/Arguments

The appellants argued that the compensation awarded by the Tribunal is inadequate considering the nature of injuries, permanent disability, and medical expenses. The insurance company opposed the appeals, supporting the Tribunal's award.

Ratio Decidendi

The compensation in motor accident claims must be just and reasonable, taking into account the nature of injuries, permanent disability, loss of earning capacity, and medical expenses. The court has the power to enhance compensation if the Tribunal's award is inadequate.
