The case involves a First Appeal filed by the dependents of deceased Jayantibhai, a cleaner who died in a truck accident. The deceased was employed as a cleaner on a truck owned by Ahmed Moosa. On 20.6.1991, the truck was loaded with grate from Meghnagar to be offloaded at Ankleshwar. The deceased accompanied the truck as a cleaner. Final Decision
The appeal is allowed. The judgment and order dated 9.4.2002 passed by the Workman Compensation Commissioner in Workman (Fatal) Application No.29 of 1996 (New No.81 of 1993) is quashed and set aside. The appellants are entitled to compensation of Rs.1,05,120 with interest at 12% per annum from the date of accident i.e. 20.6.1991 till realization. The amount deposited by the appellant be disbursed to the claimants.
