Case Note & Summary
The petitioner, G.S. Prabhuswami, filed a criminal petition under Section 438 of the Code of Criminal Procedure, 1973 (CrPC) seeking anticipatory bail in connection with Crime No.19/2020 registered at Nayakanahatti Police Station, Chitradurga, for offences punishable under Sections 406, 408, 409, 420 read with Section 34 of the Indian Penal Code, 1860 (IPC). The petitioner was the owner of land bearing Sy.No.211/1 measuring 2 acres situated at Nayakanahatti village. He had obtained conversion of the land for non-agricultural purpose by order dated 09.04.2012 and a sanctioned layout plan for construction of a residential layout on 24.08.2012. Subsequently, he executed a sale agreement with the complainant in respect of the same land. The complainant alleged that the petitioner suppressed the fact of the sanctioned layout plan, thereby cheating him. The FIR was registered against the petitioner (accused No.1) and eight other accused persons. The other accused persons had obtained anticipatory bail from the Sessions Court, but the petitioner's application was rejected on the ground that he had attempted to cheat the complainant by suppressing the sanctioned layout plan. The High Court heard the matter through video conference. The court observed that the dispute was primarily civil in nature and that the petitioner was entitled to bail on the ground of parity with the co-accused who had already been granted anticipatory bail. The court allowed the petition and directed that the petitioner be released on bail in the event of his arrest, subject to certain conditions.
