The case arises from a motor vehicle accident that occurred on 28.04.2015 involving a tractor-trailer bearing registration No. KA-28/T-5533-5534, which collided with a motorcycle, resulting in the deaths of two persons: Sharanayya Kambi (pillion rider) and Rudrayya Hiremath (motorcycle rider). The claimants, being the legal representatives of the deceased, filed separate claim petitions before the Motor Accidents Claims Tribunal at Vijayapur. The Tribunal, by judgment dated 23.11.2018 and award dated 17.01.2019, awarded compensation of Rs. 10,72,000 for the death of Sharanayya Kambi and Rs. 7,72,000 for the death of Rudrayya Hiremath, along with interest at 6% per annum. For the death of Rudrayya Hiremath, aged 49 years, the High Court applied multiplier 13, added 10% future prospects to his notional income of Rs. 8,000 per month, deducted 1/3rd towards personal expenses, and awarded Rs. 12,72,000. The court also awarded Rs. 15,000 each for funeral expenses and Rs. 40,000 each for loss of consortium. The enhanced compensation was directed to be paid with interest at 6% per annum from the date of petition till deposit, with the insurance company directed to deposit the amount within eight weeks.
