Case Note & Summary
The petitioner, Sanjay Krishna Chavan, claiming to be an RTI activist and social worker, filed a Public Interest Litigation before the Bombay High Court seeking a writ of mandamus to direct the Municipal Corporation of Greater Mumbai (Respondent Nos. 2 and 3) to inquire into the alleged illegal sanction and grant of IOD and Commencement Certificate to Respondent No.1, M.M. Corporation. The petitioner also sought cancellation of the Occupation Certificate dated 22/10/2014 and demolition of the structure erected by Respondent No.1. The grievance was that Respondent No.1 had illegally constructed a 19-storeyed residential tower on land which was originally reserved for a municipal school. The petitioner contended that the procedure for modification of the development plan was not followed. The court examined the facts and found that Respondent No.1 had purchased the property by a deed of conveyance dated 24/10/1994. At the time of purchase, the land had a one-storeyed structure with a municipal school on the ground floor and a playground. Subsequently, the development plan was modified, and the land was de-reserved. The Municipal Corporation granted IOD, Commencement Certificate, and Occupation Certificate after due process. The court noted that the petitioner had suppressed material facts, including the fact that the modification of the development plan had been approved and that the construction was in accordance with the sanctioned plans. The court also observed that the petitioner had filed the PIL with ulterior motives and that it was an abuse of the process of law. The court dismissed the PIL with costs of Rs. 50,000 to be paid to the Bombay High Court Legal Services Committee.
Headnote
A) Public Interest Litigation - Locus Standi - Bonafide Litigation - The petitioner, an RTI activist, filed PIL alleging illegal construction on school land. Court examined whether the PIL was bonafide and found that the petitioner had suppressed material facts and filed the petition for ulterior motives. Held that the PIL was not maintainable as it was an abuse of process of law (Paras 1-5, 20-25). B) Municipal Law - Modification of Development Plan - Reservation of Land - The land in question was originally reserved for a municipal school but was subsequently de-reserved and included in a modification of the development plan. The court noted that the procedure under the MRTP Act was followed and the modification was duly approved. Held that there was no illegality in the change of reservation (Paras 6-10). C) Municipal Law - Occupation Certificate - Validity - The Occupation Certificate dated 22/10/2014 was challenged on grounds of non-compliance with building regulations. The court found that the certificate was issued after verification of completion and compliance with sanctioned plans. Held that the certificate was valid and no case for cancellation was made out (Paras 11-15). D) Public Interest Litigation - Costs - Abuse of Process - The court found that the petitioner had filed the PIL with mala fide intentions and suppressed facts. Consequently, the PIL was dismissed with costs of Rs. 50,000 to be paid to the Bombay High Court Legal Services Committee. Held that such frivolous PILs must be discouraged (Paras 20-25).
Issue of Consideration
Whether the construction of a 19-storeyed residential tower by Respondent No.1 on land allegedly reserved for a municipal school was illegal and whether the Occupation Certificate dated 22/10/2014 should be cancelled.
