The prospectus provided for 2% horizontal reservation for Freedom Fighter category, with 30% of those seats reserved for female candidates. No female candidate was available for the Freedom Fighter category seat. The petitioner was otherwise eligible. The respondent university, through an affidavit, referred to the admission procedure in Clause 8 of the prospectus, which included steps for filling vacant seats: Step I for filling vacant seats in reserve and unreserved categories, Step II for filling vacant female seats in reserve and unreserved categories irrespective of horizontal reservations, and Step III for conversion of female seats to male seats if no female candidate is available. The university argued that the procedure required first filling female seats under Step II before converting to male seats under Step III, and since the female seat was not filled, the petitioner could not be admitted. The court, however, held that the procedure must be read as a whole and that Step III clearly provides for conversion of female seats to male seats when no female candidate is available. The court noted that the petitioner was eligible and no female candidate was available, and therefore directed the respondent to admit the petitioner to the B.V.Sc & A.H. course for the academic year 2014-15. The court also clarified that the admission would be subject to the petitioner's eligibility and the outcome of any other proceedings. The petition was allowed with no order as to costs.
