The court, after hearing arguments, found that the petitioner was indeed detained for more than 24 hours without being produced before the Magistrate, which amounted to a violation of Article 21 of the Constitution. The court held that the State is liable to pay compensation for such illegal detention. However, the court reduced the claimed amount to Rs. 25,000, considering the circumstances. The court directed the State of Maharashtra to pay the compensation within eight weeks, with liberty to recover the amount from the erring officer. The petition was partly allowed.
