The petitioner, Dr. Bharati Sen, was appointed as a Lecturer in Library Science at SNDT Women's University on 20.6.1986. She was selected as a Reader in 1996 based on her published work being considered equivalent to a Ph.D., and she joined on 17.8.1996. She later obtained a Ph.D. in 1998 and was granted two advance increments by the University. Under the Career Advancement Scheme (CAS) for university teachers, she became eligible for promotion to Professor after completing 8 years as a Reader, i.e., from 17.8.2004. However, the Director of Education, by order dated 11.12.2008, fixed her promotion date as 3.9.2005, which she challenged. Additionally, the Joint Director of Higher Education, by order dated 17.8.2011, held that she was not eligible for the two advance increments granted for Ph.D. and directed recovery. The petitioner sought quashing of both orders and mandamus for correct fixation of pay and arrears with interest. The court held that the petitioner was entitled to promotion from 17.8.2004 as per the UGC CAS, as she had completed 8 years as Reader on that date. The court also quashed the recovery of advance increments, noting that the increments were granted by the University based on its own decision and there was no misrepresentation by the petitioner; recovery after 13 years was unjust.
