Case Note & Summary

The petitioner, Dr. Bharati Sen, was appointed as a Lecturer in Library Science at SNDT Women's University on 20.6.1986. She was selected as a Reader in 1996 based on her published work being considered equivalent to a Ph.D., and she joined on 17.8.1996. She later obtained a Ph.D. in 1998 and was granted two advance increments by the University. Under the Career Advancement Scheme (CAS) for university teachers, she became eligible for promotion to Professor after completing 8 years as a Reader, i.e., from 17.8.2004. However, the Director of Education, by order dated 11.12.2008, fixed her promotion date as 3.9.2005, which she challenged. Additionally, the Joint Director of Higher Education, by order dated 17.8.2011, held that she was not eligible for the two advance increments granted for Ph.D. and directed recovery. The petitioner sought quashing of both orders and mandamus for correct fixation of pay and arrears with interest. The court held that the petitioner was entitled to promotion from 17.8.2004 as per the UGC CAS, as she had completed 8 years as Reader on that date. The court also quashed the recovery of advance increments, noting that the increments were granted by the University based on its own decision and there was no misrepresentation by the petitioner; recovery after 13 years was unjust. The court directed the respondents to fix her pay as Professor from 17.8.2004, release arrears with 9% interest, and not recover the advance increments.

Headnote

A) Service Law - Promotion - Career Advancement Scheme - Date of Promotion - Petitioner, a Reader, was entitled to promotion as Professor under the Career Advancement Scheme from 17.8.2004, being the date of completion of 8 years as Reader, as per the University Grants Commission (UGC) Scheme - The Director of Education's order fixing promotion date as 3.9.2005 was set aside - Held that the petitioner's promotion date should be 17.8.2004 (Paras 1-10).

B) Service Law - Advance Increments - Recovery - Ph.D. Increments - Petitioner was granted two advance increments for obtaining Ph.D. while working as Reader - The Joint Director's order dated 17.8.2011 directing recovery of these increments was quashed as the increments were granted based on University's decision and there was no misrepresentation by petitioner - Held that recovery of increments granted in 1998 after 13 years is unjust (Paras 11-15).

C) Limitation - Challenge to Order - Delay and Laches - The petitioner challenged the Director's order dated 11.12.2008 in 2011 - The court condoned the delay as the petitioner was pursuing remedies and the order affected her pensionary benefits - Held that the petition is maintainable (Paras 2, 16).

Nature of Litigation

Writ petition under Article 226 of the Constitution of India challenging orders regarding promotion date and recovery of advance increments.

Remedy Sought

Quashing of order dated 11.12.2008 fixing promotion date as 3.9.2005 and order dated 17.8.2011 directing recovery of advance increments; mandamus for fixing pay as Professor from 17.8.2004 with arrears and interest.

Filing Reason

The petitioner's promotion date was incorrectly fixed and recovery of increments was ordered after 13 years.

Previous Decisions

Order dated 11.12.2008 by Director of Education fixing promotion date as 3.9.2005; order dated 17.8.2011 by Joint Director holding petitioner ineligible for two advance increments.

Issues

Whether the petitioner is entitled to promotion as Professor from 17.8.2004 under the Career Advancement Scheme? Whether the recovery of two advance increments granted for Ph.D. is valid?

Submissions/Arguments

Petitioner: She was entitled to promotion from 17.8.2004 as per UGC CAS; the advance increments were validly granted and recovery is barred by delay. Respondents: The promotion date was correctly fixed as 3.9.2005; the petitioner was not eligible for advance increments as Ph.D. was not a requirement for Reader.

Ratio Decidendi

Under the Career Advancement Scheme, a Reader is entitled to promotion as Professor on completion of 8 years of service as Reader, and the date of promotion should be the date of completion of such service. Recovery of increments granted without misrepresentation and after a long delay is unjust and cannot be sustained.

Judgment Excerpts

By this petition under Article 226 of the Constitution of India the petitioner challenges the order dated 11.12.2008 passed by the Director of Education, Maharashtra State, Pune to the extent it confers on the Petitioner date of promotion as Professor as 3.9.2005 and not 17.8.2004 as per the career advancement scheme purportedly applicable. The petitioner has further prayed for writ of mandamus against the respondents for fixing the petitioner's pay scale as a Professor from 17.8.2004 and for releasing arrears from the said date with 18% interest. By a prayer added on amendment to the writ petition, the petitioner seeks quashing of the order dated 17.8.2011 passed by the Joint Director, Higher Education Department, Mumbai Division, by which it has been held that the petitioner was not eligible for two advance increments availed by the petitioner after getting a Ph.D. when the petitioner was working on the post of a Reader.

Procedural History

The petitioner filed Writ Petition No.1147 of 2011 in the Bombay High Court challenging the Director's order dated 11.12.2008. During pendency, the Joint Director passed order dated 17.8.2011 regarding recovery of increments, which was challenged by amendment. The petition was heard and disposed of on 7.5.2014.
