The appellant, Ukandrao Parasram Uike, was convicted by the 3rd Additional Sessions Judge, Nagpur for the murder of his uncle Tulsiram under Section 302 of the Indian Penal Code and sentenced to life imprisonment and a fine of Rs. 1,000. The incident occurred on 31st July 2000 at about 6:30 a.m. near Tulsiram's house, where the appellant allegedly assaulted him with a wooden stalk used in the railing of a bullock-cart, causing his death on the spot. The dispute arose from a partition of agricultural land between the deceased and his brother Parasram, the appellant's father. The appellant and his father were charged, but the father was acquitted. The prosecution examined 13 witnesses, including eye witnesses, and the post-mortem report supported the cause of death. The appellant challenged his conviction in this appeal. The High Court, after considering the evidence, found no reason to interfere with the trial court's judgment and dismissed the appeal, upholding the conviction and sentence.
