The Third Respondent joined earlier on 22 August 1984 but only held a B.Sc. degree at that time, completing her B.Ed. in 1989. The Education Officer (Secondary) of the Zilla Parishad, upon a complaint by the Petitioner dated 27 October 1997, held that although the Petitioner acquired her B.Ed. in 1988, prior to the Third Respondent, she was not entitled to rank higher in seniority because between 4 August 1988 and 30 September 1991, the Petitioner had been granted the D.Ed pay scale. The Education Officer ruled that this period of service would not fall for classification in Category C of Schedule F to the Maharashtra Employees of Private Schools Rules, 1981. The Petitioner challenged this decision by way of a Writ Petition. The Court considered the provisions of Rule 12 and Schedule F of the MEPS Rules, 1981. The Court observed that Schedule F classifies teachers into categories based on their qualifications, not on the pay scale drawn. Category C includes teachers with B.Ed. or equivalent qualifications. Since the Petitioner possessed a B.Ed. degree from 1988, her service from that date must be counted in Category C for seniority purposes. The fact that the management paid her in the D.Ed scale for some period is irrelevant for classification under Schedule F.
