Case Note & Summary
The petitioners, claiming to be beneficiaries of the M.J. Wadia Fire Temple Trust, filed a writ petition challenging an order dated 15th September 2004 passed by the Joint Charity Commissioner, Mumbai, on their application under Section 41E of the Bombay Public Trusts Act, 1950. The trust was carrying out construction activity on its property with the help of a developer to generate funds for maintenance of the Fire Temple and other objectives. The petitioners contended that the construction was illegal and in excess of the permission granted by the Charity Commissioner. They had filed two applications before the Joint Charity Commissioner, one of which (Application No.6 of 2004) sought various injunctions. The Joint Charity Commissioner dismissed the application, leading to the present petition. The court examined the scope of Section 41E of the BPT Act and held that the provision does not confer any right on beneficiaries to seek injunction; it is a power vested in the Charity Commissioner to act suo motu or on the application of a trustee. The court noted that the petitioners' application, though also invoking Section 50, essentially sought injunctive relief under Section 41E. The court concluded that the petitioners, as beneficiaries, had no locus standi to file such an application and that their proper remedy was to approach the civil court. Accordingly, the court dismissed the writ petition, upholding the order of the Joint Charity Commissioner.
Headnote
A) Trust Law - Locus Standi of Beneficiaries - Section 41E Bombay Public Trusts Act, 1950 - The petitioners, claiming to be beneficiaries of a public trust, filed an application under Section 41E seeking injunction against construction activity. The court held that Section 41E does not confer any right on beneficiaries to seek such relief; it is a power vested in the Charity Commissioner to act suo motu or on the application of a trustee. Beneficiaries may approach the civil court for appropriate remedies. (Paras 1-5) B) Trust Law - Scope of Section 41E - Section 41E Bombay Public Trusts Act, 1950 - The provision empowers the Charity Commissioner to issue interim orders to prevent waste or damage to trust property, but only on his own motion or on application by a trustee. The court clarified that the section does not create a right in beneficiaries to invoke it. (Paras 3-5) C) Trust Law - Alternative Remedy - Section 50 Bombay Public Trusts Act, 1950 - The petitioners also invoked Section 50, but the court noted that the application primarily sought injunctive relief under Section 41E. The court held that the proper remedy for beneficiaries is to file a suit in civil court, not to seek injunction under Section 41E. (Paras 2-5)
