The Petitioner, Ansari Mohd. Zubair, was admitted to the BAMS course in Respondent No. 3 college under the management quota reserved for OBC. He claimed to belong to the 'Momin Ansari' caste, recognized as OBC in Uttar Pradesh and Maharashtra. He submitted his application for enrollment to Respondent No. 1 University on 15/16 December 2010. The University, by decision dated 24 December 2010, held that the Petitioner did not fulfill the criteria for registration because he had not submitted his caste validity certificate and had secured less than 50% marks in his Higher Secondary examination. The application was returned to the college. The Petitioner then approached the Pravesh Niyantran Samiti (Respondent No. 2), which in its meeting on 20 April 2011 did not approve the admission on the ground that the caste validity certificate and non-creamy layer certificate were not submitted. The Petitioner filed the Writ Petition impugning both decisions. The Court noted that the Information Brochure for Asso-CET 2010-11 clearly required a candidate belonging to a backward class to submit a caste validity certificate and a non-creamy layer certificate before the last date of filling the preference form. It was admitted that the Petitioner had not produced these certificates before the Committee or the University. The Court held that the requirement of producing a caste validity certificate is mandatory under the Maharashtra Act, 2000, and the Petitioner's failure to do so justified the rejection.
