The plaintiff, a sole proprietor of a construction firm, filed a summary suit under Order 37 of the Code of Civil Procedure, 1908 (CPC) against the defendant company for recovery of Rs. 1,53,08,942.32 being the balance amount due for construction work completed at the defendant's property 'Treasure Cove' in Kovalam, Trivandrum. The plaintiff had been approached by the defendant in August 2007 for interior, air conditioning, electrical, and minor exterior works. After several quotations and revisions, the defendant issued a work order on 18 February 2008 valued at Rs. 8 Crores (Rs. 6 Crores for interior and Rs. 2 Crores for exterior) on a turnkey basis. The plaintiff completed the work and raised invoices, but the defendant failed to pay the balance. The plaintiff filed the suit and took out a Summons for Judgment seeking decree. The defendant opposed, alleging poor workmanship, delay, and claiming liquidated damages and set-off. The court examined whether the defendant had raised any triable issues. The court held that the defendant's allegations were vague and unsupported by any independent evidence or expert report. The work completion certificate and architect's certificate were relied upon by the plaintiff.
