Case Note & Summary

The State of Goa and the Executive Engineer filed an appeal against the judgment of the Reference Court in a land acquisition matter, challenging the compensation awarded to the respondent, Pundlik Govind Narulkar. The sole contention raised by the appellants was that the Reference Court, while applying the capitalization method to determine the value of the acquired land, erroneously computed compensation based on the gross yield of the property instead of the net yield. The appellants relied on the Supreme Court judgment in Airports Authority of India v. Satyagopal Roy and Others, AIR 2002 SC 1423, which held that capitalization is the process of converting net income into capital value. The respondent's counsel argued that although the Valuer's report mentioned gross income at one place, the actual calculation was based on net income, and the Reference Court adopted that calculation in paragraph 12 of its judgment. The High Court examined the Reference Court's observations in paragraph 12, which stated that the yield of paddy was 25 quintals for an area of 9224 sq. mtrs at Rs. 350 per quintal, totaling Rs. 8750. The High Court noted that while the Reference Court referred to this as gross produce, it was evident from the Valuer's report that the figures pertained to net yield. Consequently, the High Court found no error in the Reference Court's approach and dismissed the appeal with no order as to costs.

Nature of Litigation

Appeal against compensation awarded in land acquisition

Remedy Sought

Appellants sought to set aside the compensation awarded by the Reference Court on the ground that the capitalization method was applied incorrectly using gross yield instead of net yield

Filing Reason

Appellants contended that the Reference Court erred in using gross yield for capitalization method

Previous Decisions

Reference Court awarded compensation based on capitalization method; the present appeal challenges that decision

Issues

Whether the Reference Court erred in using gross yield instead of net yield while applying the capitalization method for determining compensation

Submissions/Arguments

Appellants argued that the Reference Court used gross yield instead of net yield, relying on Airports Authority of India v. Satyagopal Roy; Respondent argued that the Valuer's report and the Court's calculation were based on net yield

Ratio Decidendi

In land acquisition compensation, the capitalization method must be based on net yield of the property, not gross yield. The court found that the Reference Court had in fact used net yield, as evident from the Valuer's report and the calculation in paragraph 12.

Judgment Excerpts

the capitalization is the process of converting net income of the property into its equivalent capital value. Though the Court later says that this is on the gross produce of Paddy, it is obvious from the Valuer's report that the said figures pertain to the net yield of the Paddy.

Procedural History

The Reference Court awarded compensation in a land acquisition matter. The State of Goa and the Executive Engineer filed First Appeal No. 126/2001 before the High Court of Bombay at Goa challenging the compensation. The High Court heard the appeal and dismissed it on 23rd June 2011.
