Case Note & Summary

The petitioners, G.H.R. Education Foundation Society and Dr. Preeti Agrawal, filed a writ petition before the Bombay High Court challenging the decision of North Maharashtra University, Jalgaon, refusing to approve the appointment of Dr. Preeti Agrawal as Director of G.H. Raisoni Institute of Information Technology, Jalgaon. The society had started the Information Technology College in 2007. In terms of an earlier decision of the Nagpur Bench of the High Court in Writ Petition No.2216/2006, the State Government and all universities were directed to take steps to fill up vacant posts of Principals in affiliated colleges by 31.05.2009. On failure to comply, the State Government and universities were directed to take necessary action against the concerned colleges. The matter was carried to the Supreme Court in Special Leave Petition No.19344/2009, and the High Court's decision was confirmed, but the Supreme Court granted extension of time for making appointments till 31.05.2010. The North Maharashtra University issued a notification on 09.03.2010 directing colleges to fill vacant posts. The society appointed Dr. Preeti Agrawal as Director, but the University refused to approve the appointment. The petitioners contended that Dr. Agrawal possessed the requisite qualifications and that the University's refusal was arbitrary. The court examined the University's decision and found that the University had not provided any valid reason for disapproval. The court held that the University's refusal was not sustainable as the appointee met the required qualifications. The court allowed the petition and directed the University to approve the appointment of Dr. Preeti Agrawal as Director.
