Case Note & Summary

The Petitioner, Ikram Suleman Qureshi, an occupant of a residential flat in Suleman Tower, an adjoining building, filed a Writ Petition challenging a No Objection Certificate dated 13 June 2009 issued by the Mumbai Building Repairs and Reconstruction Board and an IOD dated 28 January 2010 issued by the Municipal Corporation for the redevelopment of land and immovable property at Survey No.200 of Tardeo Division. The redevelopment was proposed under DCR 33(7) of the Development Control Regulations for Greater Mumbai. The Petitioner's own building had been redeveloped under the same provision, and the construction was complete. At the time of that redevelopment, the structure on the subject property comprised only a ground floor and first floor. The Petitioner's building consisted of 19 storeys. Under DCR 29, the open space for separation between any building and a single storeyed accessory building need not exceed 1.5 meters. The developer of Suleman Tower had sought and obtained condonation of deficiency in open space under DCR 64(b) from the Municipal Commissioner. The Petitioner now sought to challenge that condonation. The court considered the issues of locus standi and delay. The court held that the Petitioner failed to establish any legal right or interest in the subject property and thus lacked locus standi. Additionally, the NOC was issued on 13 June 2009 and the IOD on 28 January 2010, but the petition was filed in 2010 without explanation for the delay, making it barred by delay and laches. The court dismissed the petition.

Headnote

A) Locus Standi - Challenge to Redevelopment Permissions - Petitioner, an occupant of an adjoining building, sought to challenge NOC and IOD for redevelopment of a neighboring property - Held that the Petitioner failed to demonstrate any legal right or interest in the subject property, and thus lacked locus standi to maintain the petition (Paras 2-3).

B) Delay and Laches - Challenge to Statutory Permissions - The NOC was issued on 13 June 2009 and IOD on 28 January 2010, but the petition was filed in 2010 without explanation for the delay - Held that the petition is barred by delay and laches as the Petitioner did not approach the court promptly (Paras 2-3).

C) Redevelopment under DCR 33(7) - Open Space Requirements - The redevelopment was proposed under DCR 33(7) of the Development Control Regulations for Greater Mumbai - The Petitioner's building had already been redeveloped under the same provision, and the Petitioner now sought to challenge the condonation of deficiency in open space under DCR 64(b) granted to the developer of the adjoining building - Held that the Petitioner cannot challenge permissions granted to a different property without showing any violation of his rights (Paras 2-3).

Nature of Litigation

Writ Petition challenging a No Objection Certificate and IOD for redevelopment of an adjoining property.

Remedy Sought

Petitioner sought to quash the NOC dated 13 June 2009 and IOD dated 28 January 2010.

Filing Reason

Petitioner alleged that the condonation of deficiency in open space under DCR 64(b) was illegal.

Issues

Whether the Petitioner has locus standi to challenge the NOC and IOD for redevelopment of an adjoining property. Whether the petition is barred by delay and laches.

Submissions/Arguments

Petitioner argued that the condonation of deficiency in open space was illegal. Respondents contended that the Petitioner lacked locus standi and the petition was delayed.

Ratio Decidendi

A petitioner challenging statutory permissions for redevelopment of an adjoining property must demonstrate a legal right or interest in the subject property. Failure to do so results in lack of locus standi. Additionally, such challenges must be brought promptly; unexplained delay bars the petition.

Procedural History
