Case Note & Summary

The case involves a civil revision application filed by the applicants (original defendant nos.5, 6, and 8) challenging a decree of eviction passed by the appellate bench of the Small Causes Court on 19 March 2010. The respondent nos.1 to 5 are the owners and landlords of commercial premises admeasuring about 10,000 sq.ft situated at Goregaon (West), Mumbai. By an agreement dated 23 March 1966, they let out the suit premises to respondent nos.6 to 9 (original defendant nos.1 to 4) on a monthly rent of Rs.4811/-. The defendant nos.1 to 4 were carrying on business in partnership in the suit premises under the name and style of M/s. Town Printary. Over time, some of the original partners died and others retired, and eventually defendant nos.5 to 9 came into possession and continued the business under the same partnership name. The landlords issued a notice to quit and filed a suit for eviction on the ground of subletting. The trial court dismissed the suit, but on appeal, the appellate bench of the Small Causes Court allowed the appeal, holding that defendant nos.5 to 9 were unlawful sub-tenants and passed a decree for possession. The applicants challenged this decision in the present revision. The applicants argued that the tenant was the partnership firm M/s. Town Printary, not the individual partners, and since the same firm continued, there was no subletting. The court, however, upheld the appellate bench's decision, finding that the change in partnership constituted subletting.

The court held that where the original tenant partners cease to be partners and new persons are inducted, it constitutes a transfer of interest in the tenancy, amounting to subletting. The court upheld the eviction decree passed by the appellate bench of the Small Causes Court. (Paras 1-3)
