The petitioner, Ravi s/o Madhukarrao Mandalkar, was appointed to the post of Assistant (Finance) by the Power Grid Corporation of India Limited by letter dated 29-5-2009. However, he was not allowed to join because, according to the respondent, he had not submitted documentary proof indicating any step towards verification and validation of his caste certificate as directed by the Joint Commissioner and Vice-Chairman of the SC/ST Caste Scrutiny Committee, Nagpur. The petitioner filed a writ petition seeking direction to allow him to join. The petitioner's counsel argued that while the respondent is entitled to have the caste certificate verified by the Caste Scrutiny Committee, this process usually takes place after the candidate has joined, and it is time-consuming and cannot precede the appointment. The court examined the appointment letter and found that it only required the candidate to produce the original caste certificate and one true copy duly attested by a Gazetted Officer in the enclosed proforma from the prescribed authority. The prescribed authority which issued the certificate to the petitioner was the Executive Magistrate. The court held that the petitioner had complied with the terms of the appointment in this regard. The respondent's counsel submitted that the petitioner would be allowed to join if he complied with Clause 9(a) and Note-v of the appointment letter, which required bringing the original certificate and a true copy. The court noted that there was no condition requiring prior verification by the Scrutiny Committee before joining. Accordingly, the court allowed the petition and directed the respondent to permit the petitioner to join within two weeks, subject to the petitioner producing the original caste certificate and a true copy. The court also directed that the respondent may proceed with the verification of the caste certificate through the Scrutiny Committee after the petitioner joins.
