However, possession of the land had allegedly been handed over to MDA by the State Government on 31 July 1992. The Urban Land (Ceiling and Regulation) Act was repealed in 1999, and the Competent Authority dismissed the ceiling case on 15 June 2001 under Section 4 of the Repeal Act, abating the proceedings. MDA auctioned 600 sq. mt. of land in 2008, which the first respondent challenged through a writ petition; the High Court disposed of it on 11 September 2008, granting liberty to file a civil suit. The auction was approved on 12 September 2008, and a sale deed was executed between MDA and the appellant on 20 March 2009. The first respondent then instituted a suit seeking a declaration that the auction was illegal and void and a permanent injunction against dispossession, later amending the plaint to specify lands in Schedules A and B. MDA and the appellant filed written statements contesting the suit, arguing that the land had vested in the State and that the sale to the first respondent was void. The Trial Court framed issues including ownership and auction validity, and on 18 October 2011, it dismissed the suit, holding MDA as the lawful owner and the auction valid, noting that possession had been handed over to MDA on 31 July 1992. The High Court, however, allowed the first appeal, declaring the auction null and void. The Supreme Court considered the appeal to resolve the conflicting findings on title and auction validity.
