The petitioners invoked Article 226 of the Constitution, seeking a writ of mandamus directing the employer to extend benefits under the Maharashtra Civil Service (Pension) Rules, 1982 and the existing General Provident Fund Scheme, and a declaration of their entitlement to such pensionary benefits. The State opposed the petition through the Assistant Government Pleader, arguing against the applicability of OPS, but the court found no factual dispute as the dates and events were clear and the petitioners were squarely covered by Clause No.2(1) of the 2024 Government Resolution.
