The original owner, Nasyam Jamal Saheb, died, and his five children partitioned the properties under a registered partition deed dated 11.03.1953. Sarambee, one of the children, received 1 acre 16 cents in Survey No. 706/A9 and executed gift deeds in 1968 to her daughters Kareembee and Ashabee, and sons Khasimsa and Abdul Rajak. Subsequent partitions and sales occurred, including registered sale deeds dated 24.08.2010 by Khatif Khaja Hussain and Khatif Noor Ahammed, sons of Kareembee, selling land to the appellants. The appellants, as original defendant Nos. 9 & 10, filed an application under Order VII Rule XI of the Code of Civil Procedure, 1908 (CPC) for rejection of the plaint. The Trial Court dismissed the application, and the High Court affirmed this dismissal in Revision Petition (CRP) No. 179/2021.
