Case Note & Summary

The dispute involved the absorption of company paid staff working under Official Liquidators in various High Courts into regular government service. The appellants, including the Official Liquidator and the Government of India, challenged the orders of the Calcutta and Delhi High Courts, which directed the absorption of these employees into regular posts. The employees were divided into two categories: those appointed by the Government and those engaged under Rule 308 of the Companies (Court) Rules, 1959, who were paid from company funds. The High Courts found that the company paid staff performed similar duties to regular employees but were denied equal pay and benefits. The Supreme Court, after reviewing the findings of the High Courts, dismissed the appeals, agreeing that the company paid staff should be treated equally and directed the Government to create a scheme for their absorption. The Court emphasized the need for fairness and equity in employment, particularly given the long service of these employees without proper benefits. The Government was given six months to implement a new absorption scheme, failing which the High Court orders would stand confirmed. The judgment reinforced the principle of equality in employment and the rights of long-serving employees to fair treatment.

Judgment Excerpts

We are unable to agree with the contention of the learned Senior Counsel for the appellants that the company-paid staff cannot be absorbed/regularised as they were not employed by the Government in accordance with the rules. The orders of the High Court challenged in these appeals do not call for any interference having regard to the facts presented before the High Courts. We want to give an opportunity to the appellants in the interest of justice and to balance the equities between the parties to come forward to accept and act on the first option given in the additional affidavit.

Procedural History

The appeals were filed against the orders of the Calcutta and Delhi High Courts regarding the absorption of company paid staff. The Supreme Court granted leave and heard the appeals, ultimately dismissing them and upholding the High Court orders.
