The Court held that the condition of residence within the municipal corporation area for transfer eligibility under the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 and the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 is ultra vires the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and the Maharashtra Right to Public Services Act, 2015.
