Madras High Court Quashes Show-Cause Notice and Directs Regularization of Professor in Tamil University — Prior Judicial Approval of Appointment Bars Reopening of Same Issues. Petitioner's appointment as Professor was upheld by court in earlier writ petition; subsequent show-cause notice based on same audit objections is an abuse of process and cannot be sustained.

Case Note & Summary

The petitioner, J. Devi, was appointed as Professor in Tamil Literature at Tamil University, Thanjavur, on 03.06.2017. Her appointment was challenged by an unsuccessful candidate in WP(MD)No.18392 of 2018, which was dismissed by the Madras High Court on 07.07.2022, holding that the Selection Committee had rightly concluded that the petitioner was more suited for the post. Despite this, the University issued a show-cause notice dated 20.03.2023, calling upon the petitioner to explain audit objections for the year 2021-2022, which alleged that her appointment was made by relaxing rules because her signature was not in the PBAS application form and she did not possess the required ten years' experience excluding M.Phil. and Ph.D. research period. The petitioner filed WP(MD)No.6760 of 2023 to quash the notice and WP(MD)No.8747 of 2023 seeking regularization of her services. The court found that the grounds raised in the show-cause notice were the same as those already considered and rejected in the earlier writ petition. The University had also supported the petitioner's appointment in its counter affidavit in that case. The court held that the impugned notice was an abuse of the process of court and could not be sustained. Consequently, the court quashed the notice and directed the University to regularize the petitioner's services from the date of her initial appointment, i.e., 03.06.2017, within a period of eight weeks.

Nature of Litigation

Writ petitions under Article 226 of the Constitution of India challenging a show-cause notice and seeking regularization of service.

Remedy Sought

Petitioner seeks quashing of show-cause notice dated 20.03.2023 and direction to regularize her services as Professor from the date of joining (03.06.2017).

Filing Reason

The respondent University issued a show-cause notice based on audit objections raising grounds that were already adjudicated in an earlier writ petition challenging the petitioner's appointment.

Previous Decisions

WP(MD)No.18392 of 2018 filed by an unsuccessful candidate challenging the petitioner's appointment was dismissed by this Court on 07.07.2022, upholding the selection.

Issues

Whether the show-cause notice dated 20.03.2023 is sustainable when it raises grounds already considered and rejected by this Court in an earlier writ petition. Whether the petitioner is entitled to regularization of her services.

Submissions/Arguments

Petitioner argued that the grounds in the show-cause notice were the same as those raised in the earlier writ petition which was dismissed, and the University had supported her appointment in that case. Respondents argued that the show-cause notice was based on audit objections and the petitioner was required to explain.

Ratio Decidendi

Once a court of competent jurisdiction has upheld an appointment, the employer cannot reopen the same issues through a show-cause notice based on audit objections. Such action amounts to an abuse of the process of court and is not permissible.

Judgment Excerpts

The petitioner has been working as Professor in Tamil Literature in the respondent Tamil University with effect from 03.06.2017. The writ petition ultimately came to be dismissed by this Court, by order dated 07.07.2022, holding that the Selection Committee of the University had rightly concluded that the petitioner was more suited for the post. Despite the above, the respondent has now issued the impugned notice raising the very same grounds which had already been considered and rejected by this Court.

Procedural History

The petitioner was appointed on 03.06.2017. An unsuccessful candidate filed WP(MD)No.18392 of 2018 challenging the appointment, which was dismissed on 07.07.2022. On 20.03.2023, the University issued a show-cause notice based on audit objections. The petitioner filed WP(MD)No.6760 of 2023 to quash the notice and WP(MD)No.8747 of 2023 for regularization. Both were heard together and disposed of by this common order on 29.06.2026.
