Case Note & Summary
The case involves a dispute over land measuring 2 acres 20 guntas in Jakkur Plantation, Bangalore. The plaintiff, Smt. Saroja Gupta, claimed to be the absolute owner of the property based on a sale deed dated 1.3.1982 from K. Rangappa. She alleged that in June 1993, the defendant, University of Agricultural Sciences, interfered with her possession. She filed a suit for permanent injunction (OS 10660/1993), which was dismissed on 19.9.1998 on the ground that the identity of the property was not proved. She appealed to the High Court in RFA 42/1999 but withdrew the appeal and the suit with liberty to file a fresh suit. Thereafter, she filed a fresh suit (OS 2162/2002) for declaration of title and possession. The trial court decreed the suit in her favor. The defendant appealed. The High Court reversed the trial court's decision, holding that the plaintiff failed to prove her title. She did not produce the original sale deed or any credible evidence of title. The mutation entries and tax receipts were not sufficient to prove title. The court also held that the suit was barred by limitation as the plaintiff failed to prove possession within 12 years of the suit. The appeal was allowed, and the suit was dismissed.
Headnote
A) Civil Procedure - Suit for Declaration of Title - Burden of Proof - In a suit for declaration of title and possession, the plaintiff must prove her title independently and cannot rely on the weakness of the defendant's title. The plaintiff failed to produce the original sale deed or any credible evidence of title, and the mutation entries and tax receipts were held insufficient to prove title. (Paras 2-10) B) Civil Procedure - Res Judicata - Earlier Injunction Suit - Dismissal of an earlier suit for permanent injunction on the ground that the identity of the property was not proved does not operate as res judicata in a subsequent suit for declaration of title, as the cause of action and relief sought are different. However, the finding on identity may be relevant. (Paras 3-4) C) Limitation - Suit for Possession - Article 65 of Limitation Act, 1963 - The plaintiff must prove possession within 12 years of the suit. The plaintiff failed to prove possession after 1993, and the suit filed in 2002 was held to be barred by limitation. (Paras 11-12) D) Evidence - Adverse Possession - The defendant, being a government institution, claimed title by adverse possession, but the court held that the defendant had not perfected title by adverse possession as the plaintiff failed to prove her title. (Para 13)
Issue of Consideration
Whether the plaintiff has proved her title to the suit property and is entitled to declaration of title and possession.
Final Decision
Appeal allowed. The judgment and decree dated 13.04.2010 passed in O.S.No.2162/2002 by the IX Additional City Civil and Sessions Judge, Bangalore, is set aside. The suit is dismissed.
