The matter arose from a recruitment process for 189 Dental Surgeon posts initiated by the Maharashtra Public Service Commission (MPSC) in 2015. The original applicants, Dr. Jagdish Bhalerao, Shirish Ingley, and Dr. Bharat Lad, were serving as dental surgeons on contractual basis under the National Health Mission (NHM). They applied in response to the advertisement, but were not called for interview due to MPSC's shortlisting based on higher post-graduate qualification (MDS). Challenging the shortlisting, series of original applications were filed before the Maharashtra Administrative Tribunal (MAT). The MAT, by interim order dated 23rd December 2015, directed MPSC to interview the BDS-qualified applicants. By judgment and order dated 20th March 2023, the High Court upheld the validity of shortlisting based on higher qualification but set aside the direction regarding private hospital experience. The High Court directed MPSC to consider the names of original applicants who had been interviewed pursuant to the interim order, for recommendation against the unfilled vacancies prospectively. MPSC, upon consideration, found that the original applicants had crossed the upper age limit as on the cutoff date of 1st November 2015 and therefore did not recommend them. Consequently, the original applicants filed fresh original applications before MAT seeking a direction to MPSC to relax the age limit under Rule 3(b) of the Directorate of Health Service Recruitment Rules, 1990. MAT, by order dated 25th July 2024, directed MPSC to recommend the names of the original applicants by relaxing the age limit within six weeks. MPSC challenged this order through Writ Petition Nos. 1208/2025 and 1205/2025. Dr. Bharat Lad separately filed Writ Petition No. 15021/2025 on the ground that the MAT had not accepted his plea that, being already in government service, the age restriction did not apply to him at all. The High Court heard all parties and reserved the matter on 18th June 2026, pronouncing judgment on 9th July 2026.
