Case Note & Summary

The appellant, S. Byju Nizeth Paaul, filed a writ appeal against an interim order dated 23.10.2024 passed by a learned Single Judge in W.P.(MD) No.17949 of 2024, which directed status quo as on that date regarding the appointment of the appellant as Correspondent/Secretary of Scott Christian College (Autonomous), Nagercoil. The dispute arose from a meeting of the Executive Committee of the Church of South India Kanyakumari Diocese held on 04.07.2024, where the proposal to appoint the appellant was objected to by some members. The Bishop stayed the appointment under the Church Constitution and assumed charge as Correspondent in-charge. The appellant challenged this before the Single Judge, who granted interim status quo. In the appeal, the Division Bench examined whether the interim order warranted interference. The court noted that the appellant had not made out a prima facie case or balance of convenience in his favour, as the appointment was allegedly contrary to the Church Constitution. The court also considered that the Bishop had assumed charge and that the writ petition was pending. The Division Bench dismissed the appeal, holding that the interim order was justified to maintain the status quo until the final disposal of the writ petition. The court directed the Single Judge to dispose of the writ petition expeditiously.

Nature of Litigation

Writ appeal against interim order in a writ petition concerning appointment of Correspondent/Secretary of a college.

Remedy Sought

The appellant sought to set aside the interim order of status quo granted by the Single Judge.

Filing Reason

The appellant challenged the Bishop's action of staying his appointment and assuming charge as Correspondent in-charge.

Previous Decisions

The learned Single Judge passed an interim order dated 23.10.2024 directing status quo as on that date.

Issues

Whether the interim order of status quo passed by the Single Judge should be interfered with in the writ appeal.

Submissions/Arguments

The appellant argued that the Bishop's action was without authority and that the appointment was valid. The respondents contended that the appointment was contrary to the Church Constitution and that the Bishop had power to stay it.

Ratio Decidendi

The appellant failed to establish a prima facie case or balance of convenience in his favour; the interim order was justified to maintain status quo pending disposal of the writ petition.

Judgment Excerpts

In the meeting of the Executive Meeting of the Church of South India Kanyakumari Diocese, held on 04.07.2024, at Nagercoil, to the proposal of the name of the appellant herein as the Correspondent/Secretary of the Scott Christian College (Autonomous), Nagercoil, Kanyakumari, some of the members had raised objections. The Bishop had informed the Executive Committee that he had earlier sent letters on 14.06.2024, seeking for clarification on matters relating to Scott Christian College, for which, there was no reply from the Correspondent. Accordingly, it was resolved that the proposal to appoint the appellant as the Correspondent/Secretary of the College was against the provisions of the Constitution, Chapter XIII, Sections 45.2 and 45.3, Chapter XVIII, Section 50.2F, G and H and therefore, the Bishop had stayed the same under Part-II Rule II(XII) of the Constitution of the C.S.I. Kanyakumari Diocese, until the dispute is settled by the higher body.

Procedural History

The appellant filed W.P.(MD) No.17949 of 2024 before the Madras High Court challenging the Bishop's action. The learned Single Judge passed an interim order on 23.10.2024 directing status quo as on that date. Aggrieved, the appellant filed the present writ appeal under Clause 15 of the Letters Patent. The appeal was heard and dismissed on 09.04.2025.
