Case Note & Summary
The petitioner, Yashoda Pralhad Wakade, was elected as a Ward Member (Councilor) from Ward No.6 of Municipal Council, Hingna on 01.11.2015, from a seat reserved for Scheduled Tribes. She claimed to belong to the 'Mana' Scheduled Tribe. The Scheduled Tribe Caste Certificate Verification Committee (respondent no.2) invalidated her caste claim by order dated 22.05.2017. Aggrieved, she filed a writ petition challenging the order. The High Court had earlier protected her post on 22.12.2017. The petitioner's counsel argued that in old documents, her caste was consistently recorded as 'Mana', and in a few documents as 'Mani'. Only two documents dated 01.07.1966 recorded the caste as 'Kunbi Mana'. The counsel relied on a Division Bench judgment of the same Court dated 29.11.2017 in Writ Petition No. 5927/2013 (Ashu Dattuji Shrirame v. The Scheduled Tribe Caste Certificate Scrutiny Committee). The Court found that the Scrutiny Committee had erred by focusing only on the two documents showing 'Kunbi Mana' while ignoring the other documents showing 'Mana' or 'Mani'. The Court held that the Committee must consider all documents holistically and not pick isolated entries. The Court quashed the order dated 22.05.2017 and remanded the matter to the Scrutiny Committee for fresh consideration in light of the Division Bench judgment. The petition was allowed, and the Committee was directed to decide the matter afresh within three months.
Headnote
A) Scheduled Tribes - Caste Certificate Validation - Mana Tribe - Scrutiny Committee - The petitioner, a councilor elected from a reserved ST seat, claimed to belong to 'Mana' Scheduled Tribe. The Scrutiny Committee invalidated her claim relying on two documents of 01.07.1966 showing 'Kunbi Mana', while ignoring other documents consistently showing 'Mana' or 'Mani'. The High Court held that the Committee must consider all documents holistically and not pick isolated entries. Relying on Division Bench judgment in Ashu Dattuji Shrirame v. The Scheduled Tribe Caste Certificate Scrutiny Committee, the Court quashed the order and directed reconsideration. (Paras 4-5) B) Scheduled Tribes - Caste Certificate - Benefit of Doubt - The Court observed that when there is a conflict in documentary evidence, the benefit of doubt should be given to the claimant, especially when the majority of documents support the claim. The matter was remanded to the Scrutiny Committee for fresh consideration in light of the Division Bench judgment. (Para 5)
Issue of Consideration
Whether the Scrutiny Committee's order invalidating the petitioner's claim of belonging to 'Mana' Scheduled Tribe, based on two documents showing 'Kunbi Mana' while ignoring other documents showing 'Mana' or 'Mani', is sustainable in law.
Final Decision
The High Court allowed the writ petition, quashed the order dated 22.05.2017 passed by respondent no.2, and remanded the matter to the Scrutiny Committee for fresh consideration in light of the Division Bench judgment in Ashu Dattuji Shrirame. The Committee was directed to decide the matter afresh within three months.
