Case Note & Summary

The petitioner, Aniruddha Sadashiv Pande, a journalist from Yavatmal, had taken a loan from the Yavatmal Urban Cooperative Bank Ltd. (respondent no.3). Upon his default, the bank initiated recovery proceedings and conducted an auction of his property (a plot) to recover the dues. Respondent no.5, Sachin Bhaurao Dakre, participated in the auction and was declared the highest bidder. He deposited the entire bid amount. However, the sale was not confirmed by the competent authority under the Maharashtra Cooperative Societies Act, 1960 and the Maharashtra Cooperative Societies Rules, 1961. The petitioner challenged the auction sale before the Divisional Joint Registrar (respondent no.1) by filing a revision application. The Divisional Joint Registrar, by order dated 13.04.2016, allowed the revision application filed by respondent no.5 and directed that the sale be confirmed in his favour as the auction purchaser. Aggrieved, the petitioner filed the present writ petition before the Bombay High Court. The central legal issue was whether a vested right had accrued in favour of respondent no.5 such that the sale stood confirmed. The petitioner argued that no vested right accrues until the sale is confirmed by the competent authority, and that the revisional authority erred in confirming the sale without considering the statutory requirements. The respondents contended that since respondent no.5 had deposited the entire amount, he had acquired a vested right and the sale should be confirmed. The court analyzed the provisions of the Maharashtra Cooperative Societies Act, 1960, particularly Section 101, and the Maharashtra Cooperative Societies Rules, 1961, Rule 107, which govern the sale of property in recovery proceedings. The court held that a vested right in an auction purchaser accrues only upon confirmation of the sale by the competent authority. Mere deposit of the bid amount does not confer any right. The revisional authority's order confirming the sale was premature and without proper consideration of the petitioner's objections. The court allowed the writ petition, set aside the order of the Divisional Joint Registrar, and remanded the matter back to the revisional authority for fresh consideration in accordance with law. The court directed that the petitioner be given an opportunity to raise all objections before the revisional authority, which shall decide the matter afresh within a stipulated period.

Headnote

A) Cooperative Law - Auction Sale Confirmation - Vested Right - Maharashtra Cooperative Societies Act, 1960, Section 101 and Maharashtra Cooperative Societies Rules, 1961, Rule 107 - The central issue was whether a vested right accrued in favour of the auction purchaser (respondent no.5) when he deposited the entire bid amount in an auction conducted by the cooperative bank for recovery of dues from the petitioner. The court held that no vested right accrues until the sale is confirmed by the competent authority, as per the statutory scheme under the Act and Rules. The order of the Divisional Joint Registrar confirming the sale was set aside because the sale had not been confirmed earlier and the petitioner had raised valid objections. (Paras 2, 10-12)

B) Cooperative Law - Revision Jurisdiction - Scope - Maharashtra Cooperative Societies Act, 1960, Section 154 - The revisional authority (Divisional Joint Registrar) has the power to examine the legality and propriety of the sale process. In this case, the revisional authority allowed the revision application of the auction purchaser and confirmed the sale, but the High Court found that the authority failed to consider that no vested right had accrued and that the sale confirmation was premature. (Paras 2, 10-12)

C) Cooperative Law - Recovery of Dues - Auction Sale - Confirmation - The court emphasized that the auction sale in recovery proceedings under the Cooperative Societies Act is not complete until confirmed by the Registrar or his delegate. Mere deposit of the bid amount does not confer any right to the auction purchaser. The petitioner's objections regarding the sale process were valid and required consideration before confirmation. (Paras 10-12)

Nature of Litigation

Writ petition challenging order of Divisional Joint Registrar confirming auction sale of property in recovery proceedings by cooperative bank.

Remedy Sought

Petitioner sought setting aside of order dated 13.04.2016 passed by respondent no.1 allowing revision application and confirming sale in favour of respondent no.5.

Filing Reason

Petitioner's property was auctioned by the bank for recovery of loan dues; the auction purchaser deposited the bid amount but sale was not confirmed; revisional authority confirmed sale without considering that no vested right had accrued.

Previous Decisions

The Divisional Joint Registrar (respondent no.1) by order dated 13.04.2016 allowed the revision application of respondent no.5 and directed confirmation of sale.

Issues

Whether a vested right had accrued in favour of the auction purchaser (respondent no.5) such that the sale through auction stood confirmed in his favour. Whether the revisional authority erred in confirming the sale without proper consideration of the statutory requirements under the Maharashtra Cooperative Societies Act, 1960 and Rules.

Submissions/Arguments

Petitioner argued that no vested right accrues until sale is confirmed by competent authority; revisional authority's order was premature and without jurisdiction. Respondent no.5 argued that since he deposited the entire bid amount, he acquired a vested right and sale should be confirmed.

Ratio Decidendi

A vested right in an auction purchaser accrues only upon confirmation of the sale by the competent authority under the Maharashtra Cooperative Societies Act, 1960 and the Maharashtra Cooperative Societies Rules, 1961. Mere deposit of the bid amount does not confer any right to the auction purchaser. The revisional authority must consider all objections before confirming the sale.

Judgment Excerpts

The central question that arises for consideration in the present writ petition is, as to whether a vested right had accrued in favour of respondent no.5 in the present case whereby it could be said that sale through the aforesaid process of auction stood confirmed in his favour. A vested right in an auction purchaser accrues only upon confirmation of the sale by the competent authority.

Procedural History

The petitioner defaulted on a loan from respondent no.3 bank. The bank conducted an auction of the petitioner's property. Respondent no.5 was the highest bidder and deposited the entire amount. The sale was not confirmed. The petitioner filed objections. Respondent no.5 filed a revision application before the Divisional Joint Registrar (respondent no.1), who by order dated 13.04.2016 allowed the revision and confirmed the sale. The petitioner then filed the present writ petition before the Bombay High Court challenging that order.
