The petitioner, Aniruddha Sadashiv Pande, a journalist from Yavatmal, had taken a loan from the Yavatmal Urban Cooperative Bank Ltd. (respondent no.3). Upon his default, the bank initiated recovery proceedings and conducted an auction of his property (a plot) to recover the dues. Respondent no.5, Sachin Bhaurao Dakre, participated in the auction and was declared the highest bidder. He deposited the entire bid amount. However, the sale was not confirmed by the competent authority under the Maharashtra Cooperative Societies Act, 1960 and the Maharashtra Cooperative Societies Rules, 1961. The petitioner challenged the auction sale before the Divisional Joint Registrar (respondent no.1) by filing a revision application. The Divisional Joint Registrar, by order dated 13.04.2016, allowed the revision application filed by respondent no.5 and directed that the sale be confirmed in his favour as the auction purchaser. Aggrieved, the petitioner filed the present writ petition before the Bombay High Court. The central legal issue was whether a vested right had accrued in favour of respondent no.5 such that the sale stood confirmed. The petitioner argued that no vested right accrues until the sale is confirmed by the competent authority, and that the revisional authority erred in confirming the sale without considering the statutory requirements. The respondents contended that since respondent no.5 had deposited the entire amount, he had acquired a vested right and the sale should be confirmed. Final Decision

The matter is remanded back to respondent no.1 for fresh consideration in accordance with law, after giving an opportunity of hearing to the petitioner and all concerned parties. The revisional authority shall decide the matter afresh within a period of three months from the date of the order.
