Case Note & Summary
The petitioner, Satish Ramchandra Kamdi, and respondent No.5, Ankush Kothiramji Wase, were both appointed as Assistant Teachers in a middle school run by respondent No.3 trust. The petitioner was appointed on 13.07.1983 possessing the minimum qualification of H.Sc. D.Ed as prescribed under Schedule 'B' of the Maharashtra Employees of Private Schools Rules. Respondent No.5 was appointed on 23.07.1983 as an untrained teacher with a B.A. degree. Subsequently, respondent No.5 acquired B.Ed on 23.06.1986, while the petitioner acquired B.Ed on 04.07.1994. The dispute arose over inter se seniority: the respondents treated respondent No.5 as senior because he acquired B.Ed earlier. The petitioner challenged this, arguing that seniority should be counted from the date of appointment since he already possessed the prescribed qualification. The High Court, relying on the Supreme Court's decision in Viman Vaman Awale v. Gangadhar Makhriya Charitable Trust (2014) 13 SCC 219, held that the clear criterion for seniority is continuous officiation from the date of acquiring the educational qualification prescribed under Schedule 'B'. Since the petitioner possessed H.Sc. D.Ed on his appointment date, his seniority must be counted from 13.07.1983, making him senior to respondent No.5. The court allowed the writ petition, quashed the impugned seniority list, and directed the respondents to refix seniority accordingly.
Headnote
A) Service Law - Seniority - Determination - Continuous Officiation - The criterion for determining seniority is continuous officiation counted from the date of acquiring the educational qualification as prescribed under Schedule 'B' of the Maharashtra Employees of Private Schools Rules. The petitioner, who possessed H.Sc. D.Ed on the date of appointment (13.07.1983), is senior to the respondent who was appointed later (23.07.1983) and acquired B.Ed on 23.06.1986. The fact that the respondent acquired B.Ed earlier than the petitioner (who acquired B.Ed on 04.07.1994) is irrelevant for seniority. (Paras 2-4)
Issue of Consideration
Whether seniority of assistant teachers in middle school should be determined based on the date of acquiring the minimum prescribed qualification (H.Sc. D.Ed) or the date of acquiring a higher qualification (B.Ed) subsequently
Final Decision
Writ petition allowed. The impugned seniority list is quashed and set aside. The respondents are directed to refix the seniority of the petitioner and respondent No.5 in accordance with the principle laid down in Viman Vaman Awale v. Gangadhar Makhriya Charitable Trust, treating the petitioner as senior to respondent No.5.
Law Points
- Seniority determined by continuous officiation from date of acquiring prescribed educational qualification under Schedule 'B'
- not by subsequent higher qualifications
