The petitioner, Satish Ramchandra Kamdi, and respondent No.5, Ankush Kothiramji Wase, were both appointed as Assistant Teachers in a middle school run by respondent No.3 trust. The petitioner was appointed on 13.07.1983 possessing the minimum qualification of H.Sc. D.Ed as prescribed under Schedule 'B' of the Maharashtra Employees of Private Schools Rules. Respondent No.5 was appointed on 23.07.1983 as an untrained teacher with a B.A. degree. Subsequently, respondent No.5 acquired B.Ed on 23.06.1986, while the petitioner acquired B.Ed on 04.07.1994. The dispute arose over inter se seniority: the respondents treated respondent No.5 as senior because he acquired B.Ed earlier. The petitioner challenged this, arguing that seniority should be counted from the date of appointment since he already possessed the prescribed qualification. The High Court, relying on the Supreme Court's decision in Viman Vaman Awale v. Gangadhar Makhriya Charitable Trust (2014) 13 SCC 219, held that the clear criterion for seniority is continuous officiation from the date of acquiring the educational qualification prescribed under Schedule 'B'. Since the petitioner possessed H.Sc. D.Ed on his appointment date, his seniority must be counted from 13.07.1983, making him senior to respondent No.5.
