The petitioner, Walmik Sitaram Sirsath, was appointed as an Assistant Teacher in the Government D.Ed. College, Neknoor, on 1.12.1984. He possessed a B.A. degree and a B.Ed. degree. He claimed that he was entitled to the pay scale of a Trained Graduate Teacher from the date of his initial appointment, but the respondents granted him the pay scale of an Assistant Teacher only. He also claimed pensionary benefits from the date of his initial appointment. The respondents contended that the petitioner was not entitled to the pay scale of a Trained Graduate Teacher as he was appointed as an Assistant Teacher and not as a Trained Graduate Teacher. The court examined the relevant Government Resolutions and the Maharashtra Civil Services (Pension) Rules, 1982. The court held that the petitioner, being a graduate with B.Ed., was entitled to the pay scale of a Trained Graduate Teacher as per Government Resolution dated 16.10.1997, and the denial of such scale was arbitrary. The court further held that the petitioner is entitled to pensionary benefits from the date of his initial appointment. The court allowed the writ petition and directed the respondents to fix the pay scale of the petitioner as a Trained Graduate Teacher from the date of his initial appointment and to calculate and pay the pensionary benefits accordingly within three months.
