The petitioners, Shantiniketan BahuUdeshiya Sanstha and Shantiniketan Business School, applied to the All India Council for Technical Education (AICTE) for permission to start a new MBA course from the Academic Session 2010-11. The online application was submitted on 3-4-2010, and a copy was forwarded to the respondent-University (Rashtrasant Tukdoji Maharaj Nagpur University) and the State Government. The AICTE granted approval on 23-8-2010 for an intake of 60 students, and the State Government granted permission on 30-7-2010. However, the University by its communication dated 9-9-2010 demanded affiliation fees of Rs.5,00,000/- and late fees of Rs.2,50,000/- for processing the application, claiming that the application should have been made by October 2009.
