Case Note & Summary

The petitioners, Shantiniketan BahuUdeshiya Sanstha and Shantiniketan Business School, applied to the All India Council for Technical Education (AICTE) for permission to start a new MBA course from the Academic Session 2010-11. The online application was submitted on 3-4-2010, and a copy was forwarded to the respondent-University (Rashtrasant Tukdoji Maharaj Nagpur University) and the State Government. The AICTE granted approval on 23-8-2010 for an intake of 60 students, and the State Government granted permission on 30-7-2010. However, the University by its communication dated 9-9-2010 demanded affiliation fees of Rs.5,00,000/- and late fees of Rs.2,50,000/- for processing the application, claiming that the application should have been made by October 2009. The petitioners challenged this demand in the High Court. The Court considered the legal issue of whether the University can demand such fees without rendering any service and without any statutory basis. The Court held that the demand for affiliation fees is unjustified as the University had not processed the application or rendered any service. The demand for late fees was also held to be without any provision in the Maharashtra Universities Act, 1994 or the University Ordinances. The Court allowed the petition, quashed the demand, and directed the University to process the affiliation application without insisting on payment of the disputed fees.

Headnote

A) University Law - Affiliation Fees - Demand without Service - The University demanded affiliation fees of Rs.5,00,000/- and late fees of Rs.2,50,000/- from the petitioner-institution for processing the application for affiliation to start MBA course. The Court held that the University cannot demand affiliation fees without rendering any service or processing the application, and the demand for late fees is without any statutory basis. (Paras 1-4)

B) University Law - Late Fees - Statutory Basis - The University imposed late fees for delay in making application, claiming that the application should have been made by October 2009. The Court held that there is no provision in the Maharashtra Universities Act, 1994 or the University Ordinances for levying late fees, and the demand is arbitrary and illegal. (Paras 2-4)

C) University Law - Refusal of Affiliation - Non-payment of Fees - The University refused to grant affiliation solely on the ground of non-payment of the demanded fees. The Court held that the University cannot refuse affiliation on such ground, especially when the AICTE and State Government have granted approval. The petition was allowed, and the University was directed to process the application for affiliation without insisting on payment of the disputed fees. (Paras 3-4)

Nature of Litigation

Writ petition challenging demand of affiliation fees and late fees by university

Remedy Sought

Petitioners sought quashing of demand for affiliation fees of Rs.5,00,000/- and late fees of Rs.2,50,000/- and direction to university to process affiliation application

Filing Reason

University demanded affiliation fees and late fees for processing application for affiliation to start MBA course, which petitioners contended was illegal and without authority

Issues

Whether the respondent-University can demand affiliation fees of Rs.5,00,000/- without rendering any service? Whether the demand for late fees of Rs.2,50,000/- is legally sustainable without any statutory provision?

Submissions/Arguments

Petitioners argued that the demand for affiliation fees and late fees is arbitrary and without any statutory basis, as the University had not processed the application or rendered any service. Respondent-University argued that the application was delayed and hence late fees were justified, and affiliation fees are required as per University norms.

Ratio Decidendi

A University cannot demand affiliation fees without rendering any service or processing the application, and cannot impose late fees without any statutory provision in the Act or Ordinances. The demand for such fees is arbitrary and illegal.

Judgment Excerpts

The respondent-University by its communication dated 9-9-2010 demanded the affiliation fees of Rs.5,00,000/- from the petitioners for processing their application along with late fees of Rs.2,50,000/- for the delay caused in making such application. The demand for affiliation fees of Rs.5,00,000/- cannot be sustained as the University has not rendered any service nor processed the application. The demand for late fees of Rs.2,50,000/- is also without any statutory provision in the Maharashtra Universities Act, 1994 or the University Ordinances.

Procedural History

The petitioners filed Writ Petition No.4075 of 2011 before the Bombay High Court, Nagpur Bench, challenging the demand for affiliation fees and late fees by the respondent-University. The petition was heard and decided on 23rd November 2017.
