The petitioner, Smt. Sudha Ganeshdatta Tiwari, applied for Ph.D. registration on 15.7.2010 with Rashtrasant Tukdoji Maharaj Nagpur University. Her application was considered under Direction No.10/2011 and registration was granted on 15.5.2012, with the date of registration backdated to 15.7.2010. As per clause (14) of the Directions, registration lasts for five years and expires automatically. The petitioner's registration was valid until 15.7.2015. She applied for extension on 21.4.2015, but the University rejected it on 16.10.2015 on the ground that the application was not received at least three months before expiry as mandated by Direction No.10/2011. The petitioner challenged this rejection. The court noted that the University itself delayed granting initial registration by about one year ten months, thus reducing the effective period for research. The petitioner's extension application was delayed by only six days. The court held that the requirement of three months' prior notice is directory, not mandatory, and no prejudice was caused to the University. The court also noted that the University had granted extensions to similarly situated scholars. The court allowed the petition, quashed the rejection, and directed the University to consider the extension application on merits.
