The appellant, Jacinto Baretto Miranda, owned land in Margao, Goa, which was acquired by the government for road construction. Possession was taken in 1985, but the Section 4 notification under the Land Acquisition Act, 1894 was issued only on 08/01/1991. The Land Acquisition Officer passed an award on 20/07/1994, granting compensation at ₹52/- per sq.mt., but no notice of the award was served on the appellant. The appellant received notice under Section 12(2) in January 2006 and subsequently filed a reference under Section 18 seeking enhanced compensation at ₹1000/- per sq.mt. The Reference Court partly allowed the reference, granting interest on the awarded amount of ₹82,907/- at 15% per annum and costs, but disallowed enhanced compensation. Aggrieved, the appellant appealed to the High Court. The High Court considered the location of the land, its proximity to Margao City, amenities such as road, transport, electricity, water, shops, and hospital within 80 meters, and the Kadamba Bus Stand and National Highway 17 nearby. The court found that the compensation awarded was inadequate and enhanced the market value to ₹200/- per sq.mt. The court also awarded severance charges at 30% of the market value of the acquired land and interest on the enhanced compensation at 9% per annum for the first year and 15% per annum thereafter from the date of taking possession until payment. The appeal was partly allowed.
