Case Note & Summary
The State of Maharashtra appealed against the order of the Reference Court (Joint District Judge, Nashik) dated 7th February 1992, which granted interest at 15% per annum from the date of filing of the application for additional benefits under the Land Acquisition Act, 1894, as amended by Act 68 of 1984. The land of the respondents-claimants was acquired under a notification dated 17th July 1980 under Section 4 of the Act. The Special Land Acquisition Officer made an award, against which the claimants filed a reference under Section 18. The Reference Court initially passed an award on 26th November 1982, enhancing the market value. Pending the reference, the Land Acquisition Act was amended with effect from 24th September 1984, introducing additional benefits: an additional component at 12% per annum of the market value under Section 23(1-A), increased solatium from 15% to 30% under Section 23(2), and increased interest rates under Section 34 (9% for the first year after possession, 15% thereafter). The claimants filed Miscellaneous Civil Application No.437 of 1985 seeking these additional benefits. The State opposed the application, but the Reference Court allowed it, granting the additional benefits and ordering interest at 15% per annum from the date of the application (4th February 1992) until payment or deposit. The State appealed, arguing that the order was erroneous. The High Court, after hearing the Assistant Government Pleader for the State (no appearance for the respondents), found no merit in the appeal. The Court noted that the Reference Court had correctly applied the amended provisions and that the grant of interest from the date of the application was just and proper. The appeal was dismissed with no order as to costs.
Headnote
A) Land Acquisition - Interest on Enhanced Compensation - Section 34 Land Acquisition Act, 1894 - The Reference Court granted interest at 15% p.a. from the date of filing of the application for additional benefits under the Amending Act 68 of 1984. The High Court held that the order was just and proper, as the claimants were entitled to the benefits from the date of the application, and the State's appeal was dismissed with no merit. (Paras 1-6)
B) Land Acquisition - Additional Benefits - Amending Act 68 of 1984 - The amendment introduced additional component at 12% p.a. under Section 23(1-A), increased solatium from 15% to 30% under Section 23(2), and increased interest rates under Section 34. The Court held that the Reference Court correctly applied these provisions to the pending reference. (Paras 3-5)
Issue of Consideration
Whether the Reference Court was justified in granting interest at 15% per annum from the date of filing of the application for additional benefits under the amended Land Acquisition Act, 1894, and whether the State's appeal against such order is maintainable.

Nature of Litigation
Appeal against order of Reference Court granting interest on additional benefits under Land Acquisition Act.
Remedy Sought
The State of Maharashtra sought to set aside the order of the Reference Court granting interest at 15% p.a. from the date of application for additional benefits.
Filing Reason
The State challenged the Reference Court's order dated 7th February 1992 which granted interest at 15% p.a. from the date of filing of the application for additional benefits under the amended Land Acquisition Act.
Previous Decisions
The Reference Court (Joint District Judge, Nashik) passed an award on 26th November 1982 in Land Reference No.87 of 1981, enhancing the market value. Subsequently, on 7th February 1992, it passed an order on Miscellaneous Civil Application No.437 of 1985 granting additional benefits and interest.
Issues
Whether the Reference Court was justified in granting interest at 15% per annum from the date of filing of the application for additional benefits under the amended Land Acquisition Act, 1894.
Whether the State's appeal against the order granting additional benefits and interest is maintainable and has merit.
Submissions/Arguments
The Appellant-State opposed the grant of additional benefits and interest, arguing that the order was erroneous.
The Respondents-Claimants sought the additional benefits under the Amending Act 68 of 1984, including enhanced solatium, additional component, and higher interest.
Ratio Decidendi
The Reference Court's order granting interest at 15% per annum from the date of filing of the application for additional benefits under the amended Land Acquisition Act, 1894, was just and proper. The State's appeal lacked merit and was dismissed.
Judgment Excerpts
The challenge in this Appeal is to the Judgment and Order dated 7th February 1992 passed by the Reference Court of Joint District Judge at Nashik, thereby correcting its Award dated 26th November 1982 in Land Reference No.87 of 1981 and directing the State to pay the interest @ 15% p.a. from 4th February 1992 until the entire compensation amount is paid to the Respondents-Claimants or it is deposited in the Court.
In view of this Amendment Act, the Respondents-Claimants filed Miscellaneous Civil Application No.437 of 1985, seeking these additional benefits, which were not awarded in the Judgment and Award dated 26th November 1982.
After hearing learned counsels for both the parties, the Trial Court was pleased to pass the impugned order dated 7th February 1992, granting additional benefits to the Respondents-Claimants, as per the amended provisions of the Land Acquisition Act, 1894.
Procedural History
The land was acquired under Section 4 notification dated 17th July 1980. The Special Land Acquisition Officer made an award. The claimants filed a reference under Section 18, which was decided by the Joint District Judge, Nashik, on 26th November 1982, enhancing market value. Pending reference, the Land Acquisition Act was amended by Act 68 of 1984 with effect from 24th September 1984. The claimants filed Miscellaneous Civil Application No.437 of 1985 seeking additional benefits. The Reference Court allowed the application on 7th February 1992, granting additional benefits and interest at 15% p.a. from the date of application. The State appealed to the High Court in First Appeal No.622 of 1994, which was dismissed on 9th May 2017.
