The petitioner, Sujyoti India (P) Limited, a private limited company and authorized distributor of SKF India Limited, entered into a rate contract with Western Coalfields Limited (WCL) on 11.12.1995 for supply of SKF imported bearings. Pursuant to the contract, WCL placed orders and the petitioner supplied bearings. However, WCL withheld payment of admitted dues of Rs.1,46,66,383.33 based on a letter dated 26.04.2011 issued by the General Manager (M.M.) WCL and a vigilance report dated 10.04.2015 from the Chief Vigilance Officer, Coal India Limited. The petitioner filed a writ petition seeking quashing of the letter and report and direction for payment with interest. The court found that the impugned actions were taken without any notice or opportunity of hearing to the petitioner, violating principles of natural justice. The court quashed the letter and report and directed WCL to pay the admitted amount with interest at 9% per annum from the date of filing of the petition till realization.
