The petitioner, Shri Shamba M. The respondents had placed his promotion in a sealed cover due to pending disciplinary proceedings or vigilance clearance. The court examined the Office Memorandum and found that the sealed cover procedure applies only when adverse remarks are communicated or when there is a specific reason. Since no adverse remarks were communicated to the petitioner, the court directed the respondents to open the sealed cover and, if the petitioner is found fit, to promote him to the post of Superintendent of Police (Senior Grade) with all consequential benefits.
