Case Note & Summary
The petitioner, Shri Sitakant S. Dubhashi, claimed to be a noted freedom fighter who participated in the liberation movement of Goa, Daman and Diu Phase II (1954-55) and was recognized by the Government of Goa with an identity card. In 2008, he was felicitated by the then Governor of Goa. He filed a writ petition seeking a declaration that the decision of the Government of India dated 4/2/2003 and the notification dated 17/2/2003, which restricted pension entitlement to freedom fighter participants of Goa Liberation Movement Phase II who were in receipt of pension as on 1/08/2002, was arbitrary, null and void being violative of Article 14 of the Constitution of India. He also sought a writ of mandamus directing the respondents to consider his application for grant of pension under the Swatantra Sainik Sanman Pension Scheme 1980 for Goa Liberation Movement Phase II (1954-55), and a writ of certiorari quashing communications dated 16/11/2009 and 13/11/2014 from the Ministry of Home Affairs. The respondents opposed the petition, arguing that the cut-off date was fixed based on policy decisions. The court analyzed the scheme and found that the cut-off date was arbitrary and discriminatory, as it excluded genuine freedom fighters who were recognized after that date. The court held that the petitioner was entitled to pension and directed the respondents to consider his application afresh without reference to the impugned cut-off date. The petition was allowed with no order as to costs.
Headnote
A) Constitutional Law - Right to Equality - Arbitrary Classification - Article 14 of the Constitution of India - The court considered whether the cut-off date of 1/08/2002 for pension eligibility under the Swatantra Sainik Sanman Pension Scheme 1980 for Goa Liberation Movement Phase II participants was arbitrary and violative of Article 14. The court held that the restriction based on the date of receipt of pension was unreasonable and discriminatory, as it excluded genuine freedom fighters who were recognized later. (Paras 2-5) B) Pension Law - Swatantra Sainik Sanman Pension Scheme 1980 - Eligibility for Pension - The petitioner, a recognized freedom fighter of Goa Liberation Movement Phase II (1954-55), sought pension under the scheme. The court held that the petitioner was entitled to pension as the cut-off date was arbitrary and the scheme should be applied uniformly to all recognized freedom fighters. (Paras 2-6)
