Case Note & Summary

The petitioners, owners of land in Sanguem, Goa, challenged the acquisition of their property for construction of a parallel bridge. They purchased portions of land through registered sale deeds in 1995, 1999, and 2004. On 31.01.2013, a notification under Section 4 of the Land Acquisition Act, 1894 was issued for acquisition of a portion of their land for the bridge. The petitioners and other villagers raised objections on 03.04.2013 and 14.11.2013. The Special Land Acquisition Officer submitted a report under Section 5A on 31.12.2013 rejecting the objections. Thereafter, the Government issued a declaration under Section 6 on 29.01.2014, published on 13.02.2014, and an award was passed on 08.07.2015. The petitioners contended that the acquisition would affect their residential structures and render them without alternative accommodation. The court examined the submissions and found that the objections were considered, the acquisition was for a public purpose, and the procedure was followed. The court dismissed the writ petition, upholding the acquisition and the award.

Headnote

A) Land Acquisition - Section 5A Objections - Consideration of Objections - The Special Land Acquisition Officer considered the objections raised by the petitioners and submitted a report under Section 5A of the Land Acquisition Act, 1894, rejecting the objections. The court held that the report was duly considered by the Government before issuing the Section 6 declaration, and there was no violation of principles of natural justice. (Paras 2-3)

B) Land Acquisition - Public Purpose - Construction of Bridge - The acquisition was for construction of a parallel bridge, which is a public purpose. The court held that the acquisition was for a public purpose and the petitioners' contention that their residential structures would be affected does not vitiate the acquisition. (Paras 2-3)

C) Land Acquisition - Award - Challenge to Award - The petitioners challenged the award dated 08.07.2015. The court held that the award was passed after following due procedure and the petitioners are entitled to compensation as per law. (Para 1)

Nature of Litigation

Writ petition challenging land acquisition proceedings for construction of a parallel bridge.

Remedy Sought

Quashing of Section 4 notification, Section 5A report, Section 6 declaration, and award.

Filing Reason

Petitioners' land was acquired for bridge construction; they claimed their residential structures would be affected and objections were not properly considered.

Previous Decisions

Section 4 notification dated 31.01.2013, Section 5A report dated 07.01.2014, Section 6 declaration published on 13.02.2014, award dated 08.07.2015.

Issues

Whether the acquisition of the petitioners' land for construction of a parallel bridge was vitiated by non-consideration of objections under Section 5A of the Land Acquisition Act, 1894? Whether the acquisition was for a public purpose?

Submissions/Arguments

Petitioners argued that the acquisition would affect their residential structures and render them without alternative accommodation. Respondents contended that the objections were considered, the acquisition was for a public purpose, and due procedure was followed.

Ratio Decidendi

The objections under Section 5A were considered by the Special Land Acquisition Officer and the Government before issuing the Section 6 declaration. The acquisition for construction of a bridge is a public purpose. The petitioners are entitled to compensation as per law.

Judgment Excerpts

The above petition, inter alia, prays for a writ or direction to quash and set aside the Notification No. 23/3/2013-RD dated 31.01.2013 under Section 4 of the Land Acquisition Act... It is the main contention of the Petitioners that by the proposed acquisition the residential structures of the Petitioner would be affected, thereby render the Petitioners without any other alternative accommodation.
