The case arises from insolvency proceedings against Arjunlal Sunderdas (the insolvent). The Division Bench reversed this decision. The Court held that under Section 28(2), all property of the insolvent vests in the Official Assignee, regardless of possession. The attachment before judgment does not prevent vesting; it only prohibits alienation. The Court directed the advocates to hand over the title deeds to the Official Assignee and permitted the Official Assignee to sell the property, with the sale proceeds to be applied to the claims of creditors, subject to the rights of the attaching creditor. The appeal and applications were allowed.
