The original petitioner, a daily wager, had approached the Labour Court seeking regularization. By award dated 02.01.2009 in LCR No.23 of 1995, the Labour Court directed the State to grant benefits under Government Resolution dated 17.10.1988 instead of regularization. The State challenged the award in Special Civil Application No.1368 of 2010 before the High Court of Gujarat, which stayed the award during pendency. The High Court dismissed the petition on 19.04.2017, directing implementation within six weeks. The differential pay of Rs.13,52,829 was eventually paid in March 2019 following contempt proceedings in MCA No.1314 of 2018. The original petitioner retired on 28.02.2019 and filed the present writ petition seeking interest on the delayed payment of retiral dues and the differential pay. During pendency, the original petitioner died and his legal heirs were substituted. The retiral benefits including pension, gratuity, and leave encashment were paid to the heirs only in February 2026, while the differential pay had already been paid earlier. The petitioners contended that the delay entitled them to interest on both amounts. The State argued that there was no intentional delay regarding the differential pay due to the stay on the award and that the petitioner had not previously sought interest. As for retiral benefits, the State claimed the time taken was for calculation and not deliberate. The court found that the differential pay was not unjustifiably delayed because of the legal stay and absence of any prior demand for interest, thus denying interest on that head. However, for retiral benefits, there was no justifiable reason for the seven-year delay after retirement, and applying the principle from D.D. Tewari (Dead) Through Legal Representatives Vs. Uttar Haryana Bijli Vitran Nigam Limited & Ors., (2014) 8 SCC 894, the court held the State liable to pay interest. The petition was partly allowed, directing interest at 6% per annum on the retiral benefits from 1 March 2019 till actual payment, with time-bound compliance and penalty for further delay.

Relying on the settled principle in D.D. Tewari (Dead) Through Legal Representatives Vs. Uttar Haryana Bijli Vitran Nigam Limited & Ors., (2014) 8 SCC 894, the court directed the respondents to pay 6% interest per annum on the arrears of pension, gratuity, and leave encashment from 01.03.2019 till actual payment, to be calculated by 30.04.2026 and paid by 31.05.2026, failing which an additional Rs.25,000 shall be paid (Paras 9,10,11,12,13).

The amount of interest shall be calculated by 30th April 2026 and paid to petitioner No.1.1 (Ushaben Ramniklal Dhobi) by 31st May 2026, failing which an additional Rs.25,000 shall be paid. The claim for interest on the differential pay of Rs.13,52,829 is rejected. Rule made absolute to the above extent. No costs.

Submissions/Arguments

Petitioners' counsel argued that the original petitioner retired on 28.02.2019 but retiral benefits were paid only in February 2026, thus interest is payable for the delay. He further contended that the differential pay of Rs.13,52,829 was paid in 2019 despite the Labour Court award in 2009, and therefore interest should be granted for that delay. Respondent's counsel submitted that for the differential pay, the award was stayed during the State's petition, and the State had no reason to pay earlier; also, the petitioner never sought interest when the High Court directed implementation. For retiral benefits, the delay was due to calculation time and not intentional, hence no interest should be granted.

Ratio Decidendi

A government employer must pay interest for delay in payment of retiral benefits if the delay is without justifiable reason, as settled in D.D. Tewari v. Uttar Haryana Bijli Vitran Nigam Ltd. However, when the delay in paying differential salary arose from a stay of the Labour Court award and the employee never previously claimed interest, no interest is payable on that amount.
