Case Note & Summary
The Union of India and the Railway Recruitment Board filed a writ petition challenging the order of the Central Administrative Tribunal (CAT), Bengaluru Bench, dated 17.03.2015 in O.A. No. 298/2014. The CAT had directed the petitioners to reimburse the tuition fee to the respondent, Sreenivasa J., who belongs to the OBC category and was selected for the post of Health and Malaria Inspector. The respondent had appeared for the examination conducted by the Railway Recruitment Board and was declared qualified. He was called for document verification but could not produce the income certificate at that time. Consequently, he was not reimbursed the tuition fee. He approached the CAT, which allowed his application and directed the Railways to reimburse the fee. The High Court, while dismissing the writ petition, held that the non-production of the income certificate at the time of document verification is not fatal as the respondent belongs to the non-creamy layer and the certificate was subsequently produced before the Tribunal. The Court upheld the CAT's order and directed the petitioners to reimburse the tuition fee to the respondent within a period of eight weeks.
Headnote
A) Service Law - Reservation - OBC Non-Creamy Layer - Income Certificate - The issue was whether an OBC candidate who failed to produce an income certificate at the time of document verification but later produced it before the Tribunal is entitled to tuition fee reimbursement. The Court held that the non-production of the income certificate at the time of verification is not fatal as the candidate belongs to the non-creamy layer and the certificate was subsequently produced. The Tribunal's order directing reimbursement was upheld. (Paras 1-10) B) Administrative Law - Central Administrative Tribunal - Jurisdiction - The Tribunal has the power to direct reimbursement of tuition fee to a selected candidate who was denied the benefit due to non-production of a document, if the candidate subsequently produces the document and is otherwise entitled. (Paras 5-10)
Issue of Consideration
Whether the Central Administrative Tribunal was justified in directing the Railways to reimburse the tuition fee to the respondent who belongs to OBC category and was selected for the post of Health and Malaria Inspector, despite the respondent not producing the income certificate at the time of document verification?
Final Decision
The High Court dismissed the writ petition and upheld the order of the Central Administrative Tribunal dated 17.03.2015 in O.A. No. 298/2014, directing the petitioners to reimburse the tuition fee to the respondent within a period of eight weeks.
