The appeal was filed by the claimants, legal representatives of deceased Shrishail Kore, challenging the judgment and award dated 31.03.2016 passed by the IV Addl. District & Sessions Judge and MACT-XIII, Vijayapura in MVC No.1823/2013. The deceased, aged 45 years, was an agriculturist earning Rs.6,000 per month. He died in a motor vehicle accident on 29.03.2013 when his motorcycle was hit by a Tata Indica car. The Tribunal awarded total compensation of Rs.13,36,000 with 6% interest per annum. The claimants sought enhancement. The High Court, after considering the evidence and submissions, held that the Tribunal correctly applied the multiplier of 14 and added 40% towards future prospects. However, the compensation under conventional heads was enhanced from Rs.50,000 to Rs.70,000 as per the principles laid down in National Insurance Co. Ltd. v. Pranay Sethi. The total compensation was recalculated as Rs.14,26,000. The rate of interest was maintained at 6% per annum. The appeal was partly allowed.
