The petitioner, Sri Venkatesh Kumar, filed a criminal petition under Section 439 of the Code of Criminal Procedure, 1973 (CrPC) seeking bail in Crime No.40/2020 registered by Banaswadi Police Station, Bengaluru. He was accused No.1 in the case. The court held that the seriousness of the offence alone is not sufficient to deny bail when the investigation is complete. Accordingly, the court allowed the petition and granted bail to the petitioner on certain conditions, including executing a personal bond and providing sureties, not tampering with evidence, and appearing before the court as required.
